The European legalisation ofcannabismoves into the slow-dopeylane

【1】cannabisis easily the most popularillicitdrug in Europe. About28% of adult Europeans have taken atokeduring their lifetime; the French top theleagueof stoners, at almost45%. Moreover, attitudes towards the drug’s use are changingrapidly. In Germany, for example, support for legalisation has moved from30% in favour in2014to61% last year.

【2】Yet Germany’s plans to move to full legalisation ofconsumptionand sales came to anabrupthaltlast month. Until recently, Germany’s health minister, Karl Lauterbach, had beenupbeatabout theprospectsforradicalchange. But following talks with the Europeancommissionthe plan has gone up in a cloud ofsmoke, like thecomediansCheech and Chong’s famous van made of weed. Shorn of a Germanimpetus, Europe-widecannabisreform now looks unlikely any time soon.

【3】Under Germany’srevisedstrategy, adults will be allowed to growcannabisin their own home and to form “cannabissocial clubs”. These are non-profitassociationswithin which the growth anddistributionofcannabisis permitted, though the productthe product cannot be sold to anyone else. Rather thanblazingatrailin Europe, then, the Germans are following a highlylimitedstrategythat even strict countries such as Spain and Malta have already adopted.

【4】Nobody is entirely clear why the Germanswatereddown their plans, says Dorien Rookmaker, a Dutch mep who is involved in a cross-party European Parliament group on the legalisation ofcannabisfor personal use. But Martin Jelsma of the Transnational Institute, a Dutch-founded think-tank, thinks the reason is that theproposalsare not incompliancewith an eu Councilframeworkdecision on drugs in2004, nor with threerelevantuntreaties. The eu’sframeworkagreement harmonised minimumsentencesfor drug-traffickingoffences in thebloc, but it left the eu’s member states some legaldiscretionwhen it comes to personal use, social clubs and thepossessionof weed.

【5】Germany is also now planning for a secondphasethat involves pilot projects in which local sales will be allowed. Details of theseschemeshave not yet been announced. Will they actually happen? Possibly. The Netherlands is planning to launch just such a scheme, known as the wietexperiment, or “weedexperiment”, by the end of2023in tenmunicipalities(Amsterdam’s “coffee shops” are anexemptioncarvedout before the2004frameworkcame into effect). The Czech Republic, also gung-ho on the liberalisation ofcannabislaws, seems likely to follow.

【6】The legal status of these pilotschemesfor sales is grey. Mr Jelsma says it would be helpful if thecommissionwere to give someindicationas to what its position is on the question. On the face of it theschemesdobreacheu laws. But as they are not on a national scale, and are time-limited, thecommissionmay not want to start aninfringementprocedure.

【7】The shift in German policyrepresentsakickingof the can on the full European legalisation ofcannabis. One factor may well be that no one has theappetitefor suchregulatoryaggravationright now, with a war in Ukraine and highinflationtocontendwith. Still, Ms Rookmaker thinks further shifts are still possible if enough countries keep pushing.
